MPW INTERNET SHOP REGULATIONS
§1. General
1. MPW Med. Instruments Internet Shop Regulations shall lay down the rules of submitting product inquiries pertaining to centrifuges, consumables and trade goods.
2. Product inquiries can be submitted at the following address: http://www.shop.mpw.pl
3. The Internet Shop is owned by: MPW Med. instruments with its registered office in Warsaw, 46 Boremlowska Str.
4. The Client, being a business entity or a natural person of age representing themselves and submitting a product inquiry form on their own behalf, shall be a party requesting product information from the Internet Shop.
§2. Product inquiry
1. A product inquiry pertaining to goods sold by the shop shall be accepted from a registered user using a form available at the shop’s Website which generates an inquiry number. The inquiry number shall be used in further correspondence.
2. The product inquiry shall be submitted provided that a true and correct registration form has been completed which is available at the shop’s Website.
3. Following the inquiry, the Client shall receive a confirmation of the receipt of the inquiry from our office within a period of 24 hours.
4. As part of the next stage the shop’s office shall verify the contents of the inquiry in formal terms, that is, for example, with regard to the proper selection of technical parameters of a centrifuge, proper selection of its equipment etc.
5. The Client shall have the right to revise their inquiry or resign, by e-mail or fax, prior to the development of a commercial offer.
6. In reply to the sent product inquiry the Client shall receive the commercial offer.
§3. Product provision and delivery terms
1. The product provision rules: after the Client has accepted the offer by e-mail or fax, a pro forma invoice shall be made out based on EXW with regard to the offer, being the basis for making a bank transfer.
2. Product delivery terms: following the payment under the pro-forma invoice, based on EXW, the products ordered by the Client shall be sent by courier to a designated address. The delivery shall comply with INCOTERMS 2000.
3. An invoice shall be enclosed with the shipped goods and/or sent by post. The shipment shall be accompanied by appropriate documentation of the ordered products such as guarantees, manuals, certificates etc.
4. The Client shall pay special attention to any damage to the packaging. In case it is found that the shipment was damaged:
a complaint form held by the courier shall be filled out, the shop shall be immediately contacted by phone or e-mail and notified of a situation at hand.
§4. Payment terms
The order shall be fulfilled provided that a prepayment totaling 100% of the value of the shipment is made based on the pro-forma invoice.
§5. Guarantee terms

§6. Complaints
1. Any and all complaints regarding products damaged in transport shall be considered based on a complaint protocol only drawn up in the presence of the courier.
2. The products purchased and damaged in transport shall be replaced with other products without defects after the presentation of the complaint protocol pursuant to §6.1.
3. Quantity complaints shall be made by e-mail or fax within 24 hours from the shipment’s receipt date.
4. Products damaged by the Client shall not be subject to complaints.
5. In case the products are damaged by the Client, the Client shall incur any and all related costs.
6. Complaints shall be considered based on an invoice for purchased goods only.
§6. Security
1. At present the Internet Shop relies on 128-bit SSL algorithm encryption (Secure Sockets Layer). MPW Med. instruments Shop secures any and all important data with SSL protocol as part of the HOME.PL server and records the same in secured locations preventing unauthorized use.
2. The Internet shop is protected against viruses, Trojans and Keyloggers with licensed anti-virus software.
3. Any and all data of the Clients provided in the registration process shall be processed pursuant to the Personal Data Protection Act dated 29 August 1997, shall only be used for order fulfillment purposes and shall not be disclosed to any third parties. §7. Miscellaneous
1. The Civil Code shall apply to any and all matters not provided for herein.
2. Any and all disputes shall be resolved by a court with jurisdiction over the registered office of MPW Med. Instruments in Poland.
3. Placing a product inquiry the Client within the meaning of §1.4 shall accept these Regulations. |
